Shop & Win Offer (“Offer”) - Terms and Conditions:

1. The promoter of this offer is Surya Healthcare Limited (hereinafter referred to as “SHL”)


2. The offer is only open to Permanent residents of India over the age of 18 years, as of April 1, 2011. The mere participation in the offer implies acceptance of terms and conditions of the offer.


3. Offer opens at 00:00 hours of on May 12, 2011 and closes at 12:00 midnight of September 30, 2011.The offer is strictly open for the purchases made during May 12, 2011 to September 30, 2011 only.


4. Offer open in designated markets only, as decided by SHL time to time.


5. SHL and its employees and Advertising Agencies of SHL, directly or indirectly, are not eligible to participate in this offer.  


6. Products are also available without this offer.


7. Any customer with a single bill of value Rs 250 or above is eligible for the lucky draw coupon.  


8. The participants must retain the original bill for validation by SHL, till the process for claiming the prizes is completed.


9. The winners list will be announced through a computerized random selection process. The selected winners will be informed  through SMS/ phone call during the offer period and within twenty days from the closing date of the offer.


10. SHL  is not responsible for any communication problem with regards to change of number, termination, block, out of reach, etc., of the winners, while reasonable attempts will be made to contact the winners through SMS and/or phone call.


11. The selected winners are required to submit the original bill bearing coupon number. No photocopies/ duplicate of bills shall be accepted as proof of purchase in any case.


12. Subsequent to validation, winners will be informed accordingly. The list of winners, along with their mobile numbers (if available) will also be displayed on SHL’s website, www.vivapharmacy.com  . The winners may win attractive prizes viz. Nano Cars, TVS bikes, LCD TVs, Refrigerators or any other products as decided by the SHL..


13. The redemption of some prizes will need 6-8 weeks from the date of completion of documentation formalities like advance IT payment and RTO/Insurance etc.  


14. The prizes must have been claimed within 2 months from the completion of the offer period i.e., the participant shall be eligible to claim his/her prize till October 11, 2011 only.


15. Prizes are not transferable in any circumtances. No cash or kind shall be given in lieu of prizes determined by the SHL.


16. The winners of cars and bikes are required to arrange for RTO registration, insurance, etc. All such expenses  shall be solely borne by the winners directly .


17. Prizes are subject to Income Tax as per the Income Tax laws or any other taxes/levies like sales tax as may be applicable as per the prevailing laws and the same shall be  borne by the winners directly. For the purpose of computing the advance income tax, the value of the prize won will be taken as the basis. The winners are required to deposit applicable income tax/TDS to appropriate income tax authority and obtain receipt for the same. The original invoice is required to be submitted to SHL at the time of claiming the prize.


18. Winners have to provide the following documents before receiving the prizes of Cars, Bikes, LCD TVs, refrigerators : a. The original receipt of SHL for the payment of TDS/advance income tax for the prize won in the offer, b. Copy of Pan Card of the winner, c. Indemnity bond from the winner on stamp paper declaring that the tax is paid out of his income and for the purpose of prize won in SHL Shop n Win Offer, under Section 194B of the Income Tax act, d. Address proof and e. legal release form as determined by SHL.


19. Prizes like Cars, Bikes, LCD Tvs and Refrigerators and others would be handed over to the winners at the nearest VIVA outlet to the winner or at the registered office of SHL. Winners have to make their own arrangements for travel, boarding and lodging at their cost for reaching the venue to receive/obtain the prize.


20. SHL is not responsible for the performance of the prizes like cars/bikes/LCD TVs/ refrigerators and other prizes and any loss/injury/expense arising out of the usage of the same. SHL shall not be responsible for any warranty or guarantee of any of the items/products given as prize under the offer.


21. Any disputes regarding this offer shall be subject to Indian laws and shall be subject exclusively to the jurisdiction of the courts in Delhi.


22. The submission of false, incorrect, misleading or fraudulent documentation/information  shall result in disqualification from this offer and from future SHL offers. Misrepresentation, Submission of false, misleading or fraudulent information/documentation may result in the claimant being subject to civil or criminal liability at his/her risk and costs.


23. SHL shall not be responsible for cash memos that are torn, mutilated, lost or delayed in transit. A prize-winning cash memo shall be considered invalid if it is illegible, mutilated, tampered with, not obtained legitimately, has been transferred or exchanged (whether for consideration or not), contains printing, typographical, mechanical or other errors, is unclear or does not have the requisite printed matter.


24. SHL reserves the right to change, withdraw, amend, extend, revoke and cancel the offer or any part thereof at any time without assigning any reason or any prior notice in this regard.


25. SHL reserves the right to use the information provided by participants for the administration of the draw and also to carry out research about the offer or for communication on future offers.


26. The decision of SHL (regarding this offer) shall be final and binding on the participants.


27. No queries, clarifications and suggestions shall be considered by SHL on operation or selection process which shall be solely at the discretion of SHL.


28. Participants shall have no right to challenge the decision of SHL with regard to this offer in any court of law.
29. SHL reserves the right to publish names and numbers of the winners on its website and/or in its outlets.


30. The Offer is valid at Select VIVA – your family chemist outlets only.


31. The actual prize products may differ in size, model, shape, or color as compared to the one depicted in our communications. SHL shall have absolute discretion to decide the size, model or colour etc. of the prize. No request shall be considered in this regard.
32. In a condition of accepting of prize that the winner may be required to sign a legal release in a form as determined by SHL


33. In the event that any prize is not claimed within the stipulated time, the winner shall have no right to claim the same on expiry of above said stipulated period. SHL shall have absolute discretion to decide the utility of unclaimed prize, if any.
